How Flowtex Energy collects, uses, and protects your information.

FlowTex Energy, LLC (“FlowTex,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains what information we collect, how we use and share it, and the choices you have. It applies to our website (flowtexenergy.com), our Bedrock investor portal, and our communications with you by email, phone, text message, online forms, and advertising (together, the “Services”).

By using the Services, you agree to the practices described in this policy. If you do not agree, please do not use the Services.

1. Information We Collect

Information you provide to us

  • Contact details — your name, email address, phone number, and mailing address when you complete a form, request information about our projects, sign up for updates, or otherwise communicate with us.
  • Investor qualification information — if you pursue an investment, federal securities rules require us to take reasonable steps to verify that you are an accredited investor. This may include income or net-worth information, verification letters from your CPA, attorney, or broker-dealer, and government-issued identification where required.
  • Investment and transaction information — subscription documents, joint-venture ownership records, banking details used to deliver distributions, and tax information (such as a Social Security number or EIN) needed to prepare tax documents such as Schedule K-1s.
  • Communications and content — emails, text messages, form submissions, call records, survey responses, and testimonials or feedback you agree to provide, including SMS opt-in status and consent records.

Information collected automatically

  • When you visit our website or portal, we and our service providers collect device and browser information, IP address, approximate location, pages viewed, and how you interact with our content, using cookies and similar technologies (see Section 7).
  • Our email platform records whether emails are delivered, opened, or clicked so we can manage our communications.

Information from other sources

  • Lead and contact information you submit through advertising platforms such as Meta (Facebook and Instagram) lead forms.
  • Referrals from existing partners, and information from identity or accreditation verification providers.

2. How We Use Your Information

  • To respond to your inquiries and provide information about FlowTex and our projects.
  • To operate the Bedrock investor portal and provide access to project materials and your account.
  • To verify investor eligibility and process investments, as required by federal securities law.
  • To administer joint ventures you participate in — including project updates, monthly statements, distributions, and annual tax documents.
  • To send marketing and informational communications by email or text message, which you can opt out of at any time (see Sections 3 and 4).
  • To operate, secure, and improve our website, portal, and communications.
  • To comply with legal obligations — including securities, tax, and recordkeeping requirements — and to protect our rights, our partners, and the security of the Services.

3. Text Messaging (SMS) Data and Communications

If you opt in to receive text messages from FlowTex, we collect your mobile phone number and the fact, time, and content of your consent. This information, along with any other mobile information collected in connection with SMS communications, is used solely to send you the communications you have agreed to receive and to comply with applicable law.

  • No mobile information or SMS consent data will be shared with third parties or affiliates for their own marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. We may share this information with service providers (such as our texting and telephony platform provider, currently Dialpad) strictly to deliver the service, and as otherwise described in Section 6.
  • Message frequency varies. Message and data rates may apply. Consent to receive text messages is not a condition of any purchase or investment.
  • You may withdraw SMS consent at any time by replying STOP to any message, or by contacting us at admin@flowtexenergy.com or (512) 229-1596. Reply HELP for help. See our SMS Terms & Conditions for additional detail.

4. Email Communications

You may unsubscribe from marketing emails at any time using the unsubscribe link in any message or by contacting us at admin@flowtexenergy.com. If you are an investor in an active joint venture, we will continue to send transactional and account communications — such as funding confirmations, project updates, monthly statements, and tax documents — which are part of administering your investment.

5. Phone Calls

We may communicate with you by phone using the contact information you provide. Calls with our team may be recorded or transcribed for quality, training, and recordkeeping purposes; where required by law. You may ask us at any time to stop calling you for marketing purposes.

6. How We Share Information

We do not sell your personal information for money. We share information only as described below:

  • Service providers — companies that perform services on our behalf, such as customer relationship management, email and text messaging platforms, electronic signature services, website and portal hosting and development, data storage, and analytics. They are permitted to use your information only to provide services to us, under confidentiality obligations.
  • Payment administration — an independent third-party payment administrator processes joint-venture revenue and delivers investor distributions by ACH.
  • Professional advisors — attorneys, accountants, and tax preparers who support our offerings, compliance, and reporting.
  • Operating and project partners — to the limited extent needed to administer a project you invest in (for example, ownership records for a joint venture).
  • Legal, regulatory, and safety — regulators (such as the SEC, state securities regulators, the Texas Railroad Commission, and tax authorities), and in response to subpoenas, court orders, or other lawful requests, or to protect the rights, safety, and property of FlowTex, our partners, or others.
  • Business transfers — in connection with a merger, acquisition, financing, or sale of assets, where information may be transferred as part of the transaction subject to this policy.

7. Cookies, Pixels, and Online Advertising

Our website uses cookies and similar technologies to operate the site, measure advertising performance, and show you relevant content on other platforms. These tools may collect device identifiers and browsing activity on our site.

You can manage cookies through your browser settings, and manage ad preferences directly with platforms such as Meta. Depending on your state of residence, the use of advertising pixels may be treated as “sharing” or “targeted advertising” under state privacy laws; you may opt out by contacting us at admin@flowtexenergy.com.

8. How Long We Keep Information

We keep personal information for as long as needed for the purposes described in this policy. Because our offerings are regulated private securities offerings, we are required to maintain offering, investor, and communication records for extended periods — generally at least seven years, and longer where required by securities, tax, or other law. Records subject to these requirements may not be eligible for deletion during the required retention period.

9. Your Privacy Rights and Choices

You may request access to, correction of, or deletion of your personal information by emailing admin@flowtexenergy.com. We will verify your request and honor it where required by applicable law, subject to the recordkeeping obligations described in Section 8.

  • California residents — if the California Consumer Privacy Act applies to our processing of your information, you have the right to know what personal information we collect, use, and disclose; to request deletion or correction; to opt out of any “sale” or “sharing” of personal information; and not to be discriminated against for exercising these rights.
  • Texas residents — where the Texas Data Privacy and Security Act applies, you may have similar rights of access, correction, deletion, and opt-out of targeted advertising.
  • Other states — residents of other states with privacy laws may have similar rights; we will honor requests as required by the law that applies to you.

10. Sensitive and Financial Information

Accreditation, identity, tax, and banking information is used only for eligibility verification, investment administration, distributions, tax reporting, and legal compliance. Access is limited to team members and service providers who need it for those purposes.

11. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information, including access controls and secure business systems. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If you believe your interaction with us is no longer secure, contact us immediately at admin@flowtexenergy.com.

12. Children

The Services are intended for adults and are not directed to anyone under 18. We do not knowingly collect personal information from children.

13. Third-Party Websites

Our Services may link to third-party websites and platforms (for example, social media or document-signing services). Those services are governed by their own privacy policies, which we encourage you to review.

14. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will post the updated version on this page with a new effective date. Material changes may also be communicated by email or through the Bedrock portal.
